You should have been aware of all of the documents you were signing, including court documentation and signed them individually
Consumers have been known to e-sign all documents without understanding them!
Was your income & expenses completed for you & did you see the outcome?
You should have been given a full breakdown of your income and expenses and agreed all of it.
Consumers have been known not to have completed their own income and expenses and this has been manipulated.
Were you aware of fees ?
IVA fees are normally between £2500 and £4000 and can be taken before your creditors receive any money
Consumers have been known to not understand the fee process and thought all the payments were going to creditors!
Do you believe you were vulnerable at the time you went into the IVA?
The FCA describes being in debt as vulnerable, do you have any vulnerability issues and were they taken into consideration?
Consumers have been known to be in a vulnerable position at the time they took out an IVA and advise that no understanding of the situation was considered.
Did you think the IVA was a government scheme?
You should have understood that your IVA company is a business and not government run
Consumers have been known to believe they were in a government funded scheme!
Were you aware of all of the options available to you?
The insolvency practitioner should ensure you read and understand an explanation of all the options available
